1. Overview

This website and online store are operated by ForgeOptic LLC ("ForgeOptic," "we," "us," or "our"). ForgeOptic provides ophthalmic training products, accessories, patient-oriented products, and related goods through this website.

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer and sell our products.

These Terms of Service ("Terms") govern your access to and use of our website, online store, products, and related services. By accessing the website, placing an order, or otherwise using our services, you agree to these Terms and to our Privacy Policy and Return & Refund Policy.

If you do not agree to these Terms, you should not use the website or place an order.

2. Eligibility and Customer Information

You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase through our store.

When placing an order, you agree to provide accurate, current, and complete information, including your contact, billing, payment, and shipping information.

You are responsible for maintaining the confidentiality of any customer account credentials associated with the store and for activity occurring through your account.

3. Products and Intended Use

ForgeOptic designs and sells products for a variety of purposes, including ophthalmic education, surgical-skills training, simulation, organization, equipment support, and patient use.

The intended purpose of each product is described on its applicable product page. You are responsible for reviewing the product description, instructions, specifications, dimensions, compatibility information, warnings, and intended use before purchasing or using a product.

Products described as educational, training, simulation, or practice products are intended for those purposes only. A surgical training or simulation product is not intended to be substituted for appropriate clinical education, supervision, professional judgment, or actual medical equipment used in patient care.

Products intended only for simulation or practice should not be used on patients or during actual surgical procedures unless the applicable product description expressly states that such use is intended.

Accessories, holders, stands, adapters, and similar products should be used only for their stated purpose and with compatible equipment. Customers are responsible for determining whether a product is appropriate for their particular equipment, environment, or intended application.

ForgeOptic does not provide medical advice through the sale of its products or through information appearing on this website.

4. Characteristics of 3D-Printed Products

Many ForgeOptic products are manufactured using desktop additive manufacturing, commonly known as 3D printing.

Unless otherwise stated on a product page, our printed products are supplied substantially as produced through the printing and assembly process rather than being extensively sanded, polished, painted, or cosmetically finished.

Visible layer lines, seams, minor surface roughness, small support marks, small amounts of stringing, print-bed contact marks, minor color or texture variations, and similar cosmetic characteristics may occur as part of the manufacturing process.

Minor cosmetic or dimensional variations that do not materially affect the intended function of a product are not considered manufacturing defects.

This manufacturing approach allows ForgeOptic to produce specialized products in small quantities and keep their cost substantially lower than would typically be possible with more heavily processed or traditionally manufactured products.

5. Product Images and Descriptions

We make reasonable efforts to accurately describe and photograph our products.

Because products may be produced individually and because of differences in 3D-printing materials, manufacturing conditions, lighting, photography, computer displays, and device settings, the product you receive may have minor differences in color, texture, surface appearance, or other nonfunctional characteristics from photographs shown on the website.

Product designs, dimensions, materials, colors, specifications, packaging, and availability may be changed as products are revised or improved. Material changes affecting an existing order will be addressed as reasonably appropriate before fulfillment.

We may discontinue a product or limit availability at any time.

6. Orders

Submitting an order constitutes an offer to purchase the products included in that order.

We reserve the right to accept, reject, or cancel an order when reasonably necessary, including because of product availability, pricing or listing errors, suspected fraud, payment problems, shipping limitations, or other circumstances that prevent us from properly fulfilling the order.

If we cancel an order after payment has been collected, the applicable payment will be refunded.

Please review your order carefully before submitting it. Because many ForgeOptic products are printed or prepared specifically to fulfill individual orders, cancellation may not be possible once production or personalization has begun.

Returns, replacements, and refunds are governed by our Return & Refund Policy.

7. Personalized and Custom Products

Certain ForgeOptic products may allow personalization or customization.

You are responsible for reviewing all text, names, initials, measurements, dimensions, selections, or other information that you provide when ordering a personalized or custom product.

ForgeOptic is not responsible for an error resulting from incorrect information submitted by the customer.

If ForgeOptic produces a personalized product differently from the information correctly submitted with the order, the issue will be handled in accordance with our Return & Refund Policy.

Custom or personalized products may not be eligible for change-of-mind returns.

8. Prices and Payment

Prices may change without notice. The price applicable to an order is the price displayed when the order is placed, subject to correction of clear pricing or listing errors.

Unless otherwise stated, product prices do not include shipping charges, applicable taxes, customs duties, import charges, or similar charges that may apply to an order.

You agree to provide accurate payment information and represent that you are authorized to use the payment method submitted with your order.

Payment processing is provided through Shopify and its payment providers.

9. Shipping and Delivery

Shipping and delivery dates are estimates unless expressly stated otherwise.

ForgeOptic is not responsible for delays caused by shipping carriers, customs processing, weather, natural disasters, transportation interruptions, incorrect addresses provided by customers, or other events outside our reasonable control.

You are responsible for providing a complete and accurate shipping address.

If an order arrives damaged, appears to have been lost during shipping, or contains an incorrect product, please contact ForgeOptic as described in our Return & Refund Policy so that we can review the problem.

International customers are responsible for applicable customs duties, import taxes, brokerage charges, or other fees imposed by their jurisdiction unless otherwise stated at checkout.

10. Returns and Refunds

Returns, replacements, exchanges, and refunds are governed by the ForgeOptic Return & Refund Policy available on our website.

The presence of normal 3D-printing characteristics described in these Terms does not by itself make a product defective.

Nothing in these Terms or our Return & Refund Policy limits rights that cannot legally be waived or limited under applicable consumer-protection law.

11. Product Modification and Misuse

ForgeOptic is not responsible for damage resulting from misuse, modification, improper assembly, excessive force, inappropriate cleaning or sterilization methods, exposure to temperatures or chemicals unsuitable for the material, use with incompatible equipment, or use outside a product's stated intended purpose.

Modifying a ForgeOptic product may affect its strength, dimensions, fit, or function.

Customers should inspect products before use and discontinue use of any product that is visibly damaged, cracked, significantly deformed, or otherwise appears unsafe for its intended application.

12. Intellectual Property and Open-Source Designs

The ForgeOptic name, logos, website design, photographs, written product descriptions, graphics, and other original website content are owned by or licensed to ForgeOptic and may be protected by copyright, trademark, and other applicable intellectual-property laws.

Certain ForgeOptic product designs or digital design files may separately be made available under open-source or other licenses. When a specific file or design is provided with its own license, that license controls permitted use of that file or design.

The availability of an open-source design file does not grant rights to the ForgeOptic name, logos, product photography, website content, trademarks, or other materials that are not expressly included within that license.

You may not falsely represent a product manufactured or modified by another person as having been manufactured, inspected, or approved by ForgeOptic.

13. Website Content

Information on the ForgeOptic website is provided for general product, educational, and informational purposes.

Although we try to keep website information accurate, information may occasionally contain typographical errors, inaccuracies, omissions, outdated information, or technical errors.

We may correct those errors and update product descriptions, pricing, availability, shipping information, or other website content when necessary.

Nothing on the ForgeOptic website should be interpreted as individualized medical advice, diagnosis, treatment advice, or a substitute for professional clinical judgment.

14. Third-Party Services and Links

Our website may use or link to services operated by third parties, including Shopify, payment providers, shipping providers, social-media platforms, and other websites.

Those third parties operate under their own terms and privacy practices.

ForgeOptic is not responsible for the content, availability, security, accuracy, or practices of third-party websites or services that we do not control.

15. Relationship With Shopify

ForgeOptic's online store is powered by Shopify, which enables us to provide our ecommerce services.

However, purchases made through the ForgeOptic store are transactions directly between you and ForgeOptic LLC.

Shopify is not the seller of ForgeOptic products and is not responsible for the design, manufacture, quality, safety, delivery, or use of products purchased from ForgeOptic.

To the extent permitted by applicable law, you acknowledge that Shopify and its affiliates are not responsible for claims arising from products purchased directly from ForgeOptic.

16. Privacy

Personal information collected through the website is handled in accordance with our Privacy Policy.

Because our online store is hosted by Shopify, Shopify also processes certain information concerning your access to and use of the store. Additional information concerning that processing is provided in our Privacy Policy and Shopify's applicable privacy policies.

17. Reviews, Photos, and Feedback

If you voluntarily submit a product review, photograph, suggestion, comment, testimonial, or other feedback to ForgeOptic, you represent that you have the right to provide that material.

You grant ForgeOptic permission to use, reproduce, display, and publish that material for purposes reasonably related to operating, improving, and promoting ForgeOptic and its products, unless we separately agree otherwise.

You retain ownership of your original material.

Please do not submit patient photographs, protected health information, medical records, or other confidential patient information in product reviews or other public-facing submissions.

We may remove reviews or submissions that contain unlawful content, confidential information, spam, abusive material, false information, or content that infringes another person's rights.

18. Prohibited Use of the Website

You may use the ForgeOptic website only for lawful purposes.

You may not use the website to commit fraud, interfere with its operation or security, distribute malicious software, impersonate another person, unlawfully collect information about others, infringe intellectual-property rights, engage in unlawful harassment, or otherwise violate applicable law.

We may restrict access to the website or cancel an account when reasonably necessary to address misuse, fraud, security threats, or violations of these Terms.

19. Disclaimer of Warranties

We make reasonable efforts to provide products that conform to their descriptions and intended functions.

Except for warranties expressly provided by ForgeOptic and except to the extent that applicable law provides rights that cannot be disclaimed, the website and services are provided on an "as is" and "as available" basis.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORGEOPTIC DISCLAIMS IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

Nothing in this section eliminates an express warranty created by a specific factual statement or product description to the extent applicable law provides otherwise.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORGEOPTIC LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM USE OF THE WEBSITE, DELAYS OR INTERRUPTIONS IN THE WEBSITE, OR COMMERCIAL LOSSES ASSOCIATED WITH A PRODUCT OR TRANSACTION.

TO THE EXTENT PERMITTED BY LAW, FOR COMMERCIAL OR ECONOMIC CLAIMS NOT INVOLVING PERSONAL INJURY, FORGEOPTIC'S TOTAL LIABILITY ARISING FROM A PARTICULAR PRODUCT PURCHASE WILL NOT EXCEED THE AMOUNT PAID TO FORGEOPTIC FOR THE PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply where applicable law prohibits limitation or exclusion of liability, including any liability that cannot lawfully be waived or limited.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold ForgeOptic LLC harmless from third-party claims, damages, losses, and reasonable costs arising from your unlawful use of the website, your material violation of these Terms, your infringement of another person's rights, or your unauthorized modification, resale, representation, or use of a ForgeOptic product.

This provision does not require you to indemnify ForgeOptic for liability resulting from ForgeOptic's own conduct where such indemnification would be prohibited by law.

22. Governing Law

These Terms and transactions with ForgeOptic are governed by the laws of the State of Texas and applicable federal law, without regard to conflict-of-law principles, except where the law of your jurisdiction provides mandatory consumer rights that apply regardless of this provision.

Any legal proceeding concerning these Terms will be brought before a court having proper jurisdiction and venue in Texas unless applicable law requires otherwise.

23. Severability

If a provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in effect.

24. No Waiver

If ForgeOptic does not immediately enforce a provision of these Terms, that does not constitute a waiver of the right to enforce that provision later.

25. Entire Agreement

These Terms, together with the policies referenced in them and any specific terms presented with a particular product or promotion, constitute the agreement governing your use of the ForgeOptic store and purchases from ForgeOptic.

Product-specific instructions, warnings, licenses, or terms may supplement these Terms.

26. Changes to These Terms

We may update these Terms as our products, website, business practices, or legal obligations change.

The current version will be posted on this website with an updated revision date.

Changes will apply prospectively as permitted by law. Material changes will be communicated where applicable law requires notice.
